END-USER TERMS AND CONDITIONS — Bithika Belfast

Welcome to Moreeat, a software platform owned and operated by Astracode Limited (company number NI731707). These Terms and Conditions ("Terms") govern your use of the Moreeat platform, including the moreeat.co.uk website, any associated mobile applications, and any individual restaurant websites powered by Moreeat technology (collectively, the "Platform").
By accessing the Platform or placing an order for Bithika Belfast, you agree to be bound by these Terms.
1. Our Role and the Contract of Sale
1.1 Technology Provider: Astracode Limited (trading as Moreeat) is a technology provider that facilitates online and offline food ordering. We provide the software platform that allows you to view menus and place orders with independent restaurants ("Partner Restaurants").
1.2 Contract of Sale: When you place an order through the Platform, Moreeat acts strictly as a commercial agent on behalf of the Partner Restaurant. The legal contract for the supply and purchase of food, beverages, and delivery services is formed exclusively between you and the Partner Restaurant. Moreeat is not a party to this transaction.
2. Orders and Payment
2.1 Order Acceptance: All orders are subject to acceptance by the Partner Restaurant. A notification that your order has been received does not guarantee that the restaurant can fulfill it. The Partner Restaurant reserves the right to reject an order (e.g., if they are too busy or out of stock).
2.2 Service Fees: To maintain and improve our technology infrastructure, Moreeat applies a mandatory, non-refundable Service Fee to transactions:
A range between £0.75 - £1.50 Service Fee aggreed with restaurent applies to all orders placed online via the Platform.
These fees are clearly displayed at checkout before you complete your purchase.
2.3 Pricing: Prices for menu items are set exclusively by the Partner Restaurants.
2.4 Payment: You must pay for online orders using a valid credit or debit card through our secure payment gateway. By providing payment details, you authorize us to process the full order amount, including applicable taxes, delivery fees, and Moreeat service fees.
3. Food Safety, Allergens, and Liability
3.1 Restaurant Responsibility: The Partner Restaurant is 100% solely responsible for the preparation, quality, safety, and delivery of your food.
3.2 Allergens and Dietary Requirements: Moreeat does not verify or guarantee the allergen information provided by Partner Restaurants. If you have a severe food allergy or specific dietary requirement, you must contact the Partner Restaurant directly by phone before placing your order to ensure they can safely accommodate your needs.
3.3 Limitation of Liability: To the maximum extent permitted by UK law, Moreeat accepts no liability whatsoever for:
The quality, safety, or exactness of the food provided.
Any adverse health reactions, including allergic reactions or foodborne illnesses.
Delays in food preparation or delivery times.
Any actions, omissions, or negligence on the part of the Partner Restaurant or their delivery personnel.
4. Cancellations and Refunds
4.1 Cancellations: Because orders involve perishable goods and immediate preparation, you do not have a statutory right to cancel an order once the Partner Restaurant has accepted it and begun preparation.
4.2 Refunds: Any disputes regarding food quality, missing items, or extreme delivery delays must be directed to the Partner Restaurant. As the contract of sale is with the Partner Restaurant, they are solely responsible for authorizing refunds. If a refund is authorized by the restaurant, Moreeat will facilitate the processing of that refund back to your original payment method.
4.3 Service Fee Non-Refundable: The Moreeat Service Fee is applied for the provision of the ordering technology and is non-refundable, even in the event that the Partner Restaurant issues a refund for the food.
5. Intellectual Property and Use of the Platform
5.1 Ownership: All intellectual property rights in the Platform, including the underlying software, routing technology, design, and Moreeat branding, remain the exclusive property of Astracode Limited.
5.2 Acceptable Use: You agree not to use the Platform for any fraudulent purposes, to submit false orders, or to attempt to bypass, disable, or interfere with any security features of the Platform.
6. Data Protection
Your privacy is important to us. We collect and process your personal data in accordance with UK GDPR. We act as the Data Controller for your platform account data, while Partner Restaurants act as Data Controllers for the fulfillment of your specific orders. 7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
8. Modifications to Terms
Astracode Limited reserves the right to review, modify, or update these Terms at any time based on operational, legal, or regulatory needs. Any changes will be effective immediately upon posting the updated Terms on the Platform, reflected by the "Last Updated" date at the top of this document. We encourage you to review this page periodically to ensure you are aware of the most current version. Your continued use of the Platform following any updates constitutes your explicit acceptance of the revised Terms.
